Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RangePulse ("RangePulse," "we," "us," or "our") governing your access to and use of the RangePulse application, website, APIs, cloud services, self-hosted software, and all related services (collectively, the "Service"). By accessing or using any part of the Service, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

By creating an account, downloading the software, deploying the self-hosted version, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Service, including users of the free self-hosted version and subscribers to the cloud-hosted version.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" shall refer to both you individually and the organization.

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement.

2. Description of Service

RangePulse is a health vitals tracking application that allows users to log blood pressure readings, weight, heart rate, mileage, and other personal health metrics. The Service generates PDF reports summarizing user-entered data that may be brought to medical appointments as a supplemental reference.

2.1 Cloud-Hosted Version

The cloud-hosted version of RangePulse is a paid subscription service hosted on Amazon Web Services (AWS) infrastructure, utilizing DynamoDB for data storage, Lambda for application logic, S3 for file storage, and SES for transactional email. Cloud subscribers receive managed hosting, automatic updates, encrypted data storage, and technical support as described on the pricing page.

2.2 Self-Hosted Version (Free, Open Source)

The self-hosted version of RangePulse is open-source software that users may download and deploy on their own infrastructure at no charge. Users of the self-hosted version are solely responsible for hosting, security, maintenance, backups, and all operational aspects of their deployment.

3. Not a Medical Device

RANGEPULSE IS NOT A MEDICAL DEVICE. RANGEPULSE IS NOT CLEARED, APPROVED, OR CERTIFIED BY THE U.S. FOOD AND DRUG ADMINISTRATION (FDA) OR ANY OTHER REGULATORY BODY. RANGEPULSE IS NOT SUBJECT TO, AND DOES NOT CLAIM COMPLIANCE WITH, THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) OR ANY EQUIVALENT REGULATION.

The Service does not provide medical advice, diagnoses, or treatment recommendations. The Service makes no diagnostic claims and no therapeutic claims of any kind.

The Service is not a substitute for professional medical advice, diagnosis, or treatment. You should never disregard professional medical advice or delay seeking it because of information displayed by the Service. Always consult a qualified healthcare provider with any questions regarding a medical condition.

All blood pressure readings, heart rate measurements, weight entries, mileage records, and other health data entered into the Service are self-measured and self-reported by the user. RangePulse does not validate, verify, or confirm the accuracy of any data entered. The data and reports generated by the Service are unvalidated and are intended solely as supplemental reference materials. They are not clinical records and should not be treated as such.

PDF reports generated by the Service are informational summaries of user-entered data only. They are not medical records, clinical assessments, or diagnostic reports. No healthcare provider is obligated to accept, rely upon, or act upon any report generated by the Service.

RangePulse expressly disclaims any and all liability arising from medical decisions, health outcomes, treatments undertaken, treatments foregone, or any other action or inaction based in whole or in part on data displayed by or reports generated by the Service.

4. Account Registration and Security

To use the cloud-hosted version of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your account information to keep it accurate and current.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You are responsible for all activities that occur under your account, whether or not authorized by you. You agree to notify RangePulse immediately at hello@rangepulse.com if you become aware of any unauthorized use of your account or any other breach of security.

RangePulse shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

6.1 Cloud Subscription Pricing

The cloud-hosted version of the Service is available at the following subscription rates:

RangePulse reserves the right to change subscription pricing at any time. Any price changes will be communicated to existing subscribers at least 30 days before the new pricing takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6.2 Payment Processing

All payments are processed through Stripe, Inc. ("Stripe"), a third-party payment processor. By subscribing to the cloud-hosted version, you agree to Stripe's terms of service and privacy policy. RangePulse does not directly store your full credit card number or payment credentials. All payment data is handled by Stripe in accordance with PCI-DSS standards.

6.3 Billing Cycle

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date.

6.4 Cancellation

You may cancel your cloud subscription at any time through your account settings or by contacting hello@rangepulse.com. Upon cancellation:

No refunds will be issued for any partially used billing period. If you cancel your subscription, you will not receive a prorated refund for the remainder of the current billing period. Your access will continue until the end of the period you have already paid for.

7. Data Ownership and Export

You own your data. All health data, vitals, entries, and personal information you enter into the Service remain your property. RangePulse claims no ownership interest in your data.

7.1 Data Export

You may export all of your data from the Service at any time, in a standard, machine-readable format. RangePulse will provide data export functionality for as long as your account is active.

7.2 Account Deletion

You may request deletion of your account and all associated data at any time by contacting hello@rangepulse.com. Upon receiving a verified deletion request, RangePulse will permanently delete your account and all associated data within 30 days, except where retention is required by applicable law.

7.3 Data Retention and Recovery

Deleted health readings are retained in a Recycle Bin for 35 days, during which you may restore them at any time through the application interface. After 35 days, deleted data is permanently removed. Account deletion results in immediate and permanent removal of all data, including entries in the Recycle Bin. RangePulse is not responsible for data that has been permanently deleted, whether by user action or by expiration of the 35-day retention period.

7.4 Data Use by RangePulse

RangePulse may use aggregated, de-identified, and anonymized data that cannot reasonably be used to identify any individual user for the purpose of improving the Service, generating aggregate statistics, or conducting internal research. Such aggregated data is not considered personal data or user data under these Terms.

8. Self-Hosted Version

The self-hosted version of RangePulse is provided under an open-source license as specified in the software's repository. The following additional terms apply to the self-hosted version:

9. Intellectual Property

The RangePulse name, logo, trademarks, service marks, trade dress, and all visual design elements are the exclusive property of RangePulse and are protected by applicable intellectual property laws. You may not use any RangePulse trademarks without prior written consent.

The cloud-hosted Service, including its source code, architecture, user interface, APIs, documentation, and all related materials, is the property of RangePulse and is protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the cloud-hosted Service in accordance with these Terms.

The self-hosted version of RangePulse is released under the open-source license specified in its source code repository. Your use of the self-hosted version is governed by the terms of that license in addition to these Terms. In the event of a conflict between the open-source license and these Terms regarding the self-hosted software specifically, the open-source license shall control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RANGEPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY OF THE FOLLOWING, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY:

  • Any medical decisions made in whole or in part based on data displayed by or reports generated by the Service;
  • Any health outcomes, injuries, adverse events, or deaths resulting from or related to the use of the Service;
  • Any inaccuracy, error, or omission in data entered by users or displayed by the Service;
  • Any interruption, suspension, or discontinuation of the Service, whether planned or unplanned;
  • Any loss of data, regardless of cause;
  • Any unauthorized access to or alteration of your data or transmissions;
  • Any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses;
  • Any damages arising from the self-hosted version, including but not limited to security breaches, data loss, server failure, or misconfiguration.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANGEPULSE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO RANGEPULSE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID RANGEPULSE ANY AMOUNTS (INCLUDING USERS OF THE FREE SELF-HOSTED VERSION), RANGEPULSE'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED TEN U.S. DOLLARS ($10.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations set forth above shall apply to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless RangePulse, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

RANGEPULSE SPECIFICALLY DISCLAIMS ANY WARRANTY THAT DATA ENTERED INTO THE SERVICE WILL BE ACCURATELY STORED, DISPLAYED, CALCULATED, OR REPORTED. YOU ACKNOWLEDGE THAT YOU USE THE SERVICE AND RELY ON ANY DATA OR REPORTS GENERATED BY THE SERVICE ENTIRELY AT YOUR OWN RISK.

No advice or information, whether oral or written, obtained from RangePulse or through the Service shall create any warranty not expressly stated in these Terms.

13. Termination

13.1 Termination by You

You may terminate your account and these Terms at any time by canceling your subscription (for cloud users) and/or ceasing to use the Service. You may export your data prior to termination as described in Section 7.

13.2 Termination by RangePulse

RangePulse may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Idaho, United States of America, without regard to its conflict of law principles.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact RangePulse at hello@rangepulse.com and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the State of Idaho, United States of America, unless the parties mutually agree to a different location. The language of the arbitration shall be English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND RANGEPULSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and RangePulse agree otherwise in writing, the arbitrator may not consolidate the claims of more than one person and may not preside over any form of class, consolidated, or representative proceeding.

15.4 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.

16. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

17. Changes to Terms

RangePulse reserves the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days' advance notice before the changes take effect, by posting the updated Terms on the Service and, for cloud subscribers, by sending notice to the email address associated with your account.

Your continued use of the Service after the effective date of any modified Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and, if applicable, cancel your subscription before the changes take effect.

The "Last Updated" date at the top of these Terms will be revised each time the Terms are modified. You are responsible for reviewing these Terms periodically.

19. Severability and General Provisions

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent. If modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy and any applicable open-source license for the self-hosted version, constitute the entire agreement between you and RangePulse with respect to the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

The failure of RangePulse to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by RangePulse to be effective.

You may not assign or transfer these Terms or any rights or obligations hereunder without the prior written consent of RangePulse. RangePulse may assign or transfer these Terms without restriction.

RangePulse shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or cyberattacks.
